Terms of Service.

The rules for using SilentMule, in plain words. No account, no ID: the responsibilities below are what that freedom comes with.

  1. General

    These Terms apply to everyone who uses SilentMule (the Service). By using the Service you confirm that you have read them, understood them and agree to them. If you don't agree, don't use the Service.

    SilentMule is a cryptocurrency swap service. You send coins to a deposit address, and the coins you chose are sent to the wallet you named, either as soon as the swap is done (Fast) or on the day you picked (Stealth). We don't run an order book, and nothing on the Service is investment, financial or tax advice.

  2. No account, no identity checks

    You don't need an account to use the Service, and we don't ask for your name, home address, email, phone number, government ID or photo. An order is opened with its Order ID and order key, and nothing else.

    Orders run automatically, from the quote to the deposit, the swap and the payout. We don't hold orders to ask who you are. An order can take longer than shown when a blockchain is congested, when a deposit doesn't match the order, or for a large swap; it is then completed, or the coins are returned.

    Because we don't verify identities, we can't check the source of anyone's funds or whether a particular swap is lawful where you are. That is your responsibility.

  3. Using the Service

    • You must be at least 18, or the age of majority where you live if that is higher.
    • You must follow the laws that apply to you, where you live and where you use the Service from.
    • You are responsible for the wallet address, the network, any memo or tag, and every other detail of your order. Check them before you send.
    • Coins sent to a wrong address, on a wrong network, without a required memo or tag, or in a coin the order doesn't name may not be recoverable. Where we can return them, we will, less the network fees it costs.
    • Blockchain transactions can't be reversed. Once a payout is sent, it can't be cancelled or pulled back.
    • Keep your Order ID and order key safe. Together they open your order. Nobody can reset the key, us included.
  4. Amounts, limits and rates

    A swap must be worth between $50 and $29,999, valued at the market when you order. A coin pair can have a higher minimum, shown on the desk.

    On Fast, the amount shown is what lands with every fee already out. It follows the market until your coins are traded, a few minutes after your deposit has the confirmations it needs, so the amount that lands can differ from the first number you saw. On Stealth, a swap into another coin is priced on the day it lands, and a payout in the same coin is exact.

    The Stealth fee, 2% to 6% by the day you pick, is shown before you send. Network fees after your deposit are included in what lands. The fee to send your deposit is set by your own wallet.

    If a deposit is smaller or larger than the order, or arrives after the order has expired, the swap may be recalculated at the market when it arrives, or the coins returned.

  5. How swaps are carried out

    Swaps are carried out by automated systems and through liquidity providers we choose. On Stealth, your coins are held for you until the landing day you picked, then paid out. If a provider or a network can't complete a swap, we route it another way or return the coins.

  6. Places we don't serve

    The Service is not offered to people in, or residents of, places where using a cryptocurrency swap service is against the law, or any country, region or person under comprehensive sanctions by the United Nations, the European Union, the United Kingdom or the United States. By using the Service you confirm that none of these applies to you.

  7. What you can't use the Service for

    You agree to use the Service only for lawful purposes. You must not use it to:

    • commit or help with fraud, theft, scams, phishing or any other deception;
    • launder the proceeds of crime or hide where illegal funds came from;
    • finance terrorism, sanctioned people or groups, weapons proliferation, or anything else international law forbids;
    • attack, overload, probe, scrape, reverse engineer or disrupt the Service, its systems or its API, or try to reach any part of it you aren't meant to;
    • run bots or scripts that interfere with the Service or use it abusively;
    • break any law, regulation or anyone else's rights.

    Any consequences of unlawful use, including legal action, lost funds or claims from others, are yours alone.

  8. Taking payments as a merchant

    A merchant is anyone who sets up a merchant key to take payments from other people: a shop, a studio, a freelancer, a cause. These sections apply to merchants on top of everything else in these Terms. They also apply to every checkout, payment link and pay button you make.

    Setup asks for a payout coin and network, a payout wallet and the name your customers see. We don't ask who you are. In return, you confirm that you are allowed to receive payments where you are, that the payout wallet is yours or one you control, and that what you sell is allowed under these Terms.

    Your merchant key opens your dashboard and signs your API calls. Keep it secret. We store only a one-way copy, so we can't show it again or reset it, and anything done with your key is treated as done by you.

    Each payment is a swap carried out under these Terms: your customer pays in the coin they choose, and the coin you chose is sent to your payout wallet. Your customer pays the cost of the swap, shown to them before they pay. Between two different coins you receive about your price, not exactly it; the paid webhook and your dashboard show what landed. We keep no balance for you, and there is nothing to withdraw.

    Each payment must be worth between $50 and $29,999. A payment that comes in short, late or on the wrong network is paused, and a person sorts it out with your customer: completing it, or refunding them. Refunds go back to the customer who paid, never to you.

  9. What merchants can't sell

    You may not use checkouts, payment links or pay buttons to take payment for:

    • anything illegal where you are, or where your customer is;
    • drugs or controlled substances where they are illegal, and prescription medicines without the licence the law requires;
    • weapons, ammunition, explosives, or parts and plans to make them;
    • stolen goods, counterfeits, or anything that infringes someone else's copyright, trademark or other rights;
    • stolen data, accounts, credentials or cards, malware, hacking services, or tools to break into systems;
    • any material that sexualises minors, and any intimate content shared without the consent of the people in it;
    • human trafficking, forced labour, or any exploitation of people;
    • fraud, scams, fake charities, pyramid or Ponzi schemes, or anything that promises investment returns;
    • gambling, lotteries or betting, unless you hold every licence the law requires where you and your customers are;
    • exchanging money or crypto for other people, or taking payments on someone else's behalf, without our written agreement;
    • anything for, or on behalf of, a person, group, country or region under sanctions, and anything that helps someone get around sanctions;
    • moving the proceeds of crime, or financing terrorism or weapons proliferation.

    If you're not sure whether something is allowed, write to us before you take a payment for it.

  10. Screening and switching off

    Payout wallets are checked against public sanctions lists when a merchant is set up, and again each time a checkout starts. A wallet on one of those lists can't receive merchant payments, and checkouts pause if the list can't be checked.

    We may refuse to set up a merchant, switch off a merchant, a payment link or a checkout, or stop a payment before it is paid out, if we reasonably believe these Terms are being broken, the law requires it, or the Service or its users are at risk. Where we can, we refund any payment in progress to the customer who made it.

    You can delete your merchant from the dashboard at any time. That removes your merchant record, its checkouts and its webhook history straight away. Payments already sent are on their blockchains and stay there.

  11. Your responsibilities as a merchant

    You sell to your customers; we don't. You are responsible for what you sell, for delivering it, for your own prices and terms, for refunds and complaints between you and your customers, for consumer and other laws that apply to your sales, and for your own taxes.

    If you build on the API, keep your key on your own server, check every webhook's signature before you act on it, and stay within the rate limits in the API documentation. We may change or retire parts of the API; where a change could break what you've built, we'll say so in the documentation's changelog before it takes effect.

  12. Your data

    We keep only what an order needs to work: the coins, amounts, addresses, transaction details and basic technical data such as your connection's address for rate limits. Our Privacy Policy says what we keep, for how long, and why, and forms part of these Terms.

  13. Accuracy

    We work to keep everything on the Service accurate and current, but we can't promise it is always free of errors. Rates, fees, limits, coins and networks can change without notice. Check your order before you send.

  14. Feedback

    If you send us ideas or feedback, we may use them to improve the Service, for any purpose and without owing you anything for them.

  15. No advice

    Nothing on the Service is financial, investment, legal or tax advice, including our guides, comparisons, examples, rates and quotes. They explain how things work; what you do with that is your decision. Get your own advice where you need it.

  16. Your risks

    Cryptocurrency carries risks you accept by using the Service: prices can move sharply, blockchain transactions can't be reversed, networks can be slow, congested or change their rules, coins and tokens can lose their value, and laws about crypto can change where you are. You use the Service at your own risk.

  17. Third parties and events beyond our control

    Swaps depend on things we don't run: blockchains and their nodes, wallets, liquidity providers, exchanges, hosting and internet services. We are not responsible for their failures, delays, rule changes, freezes or decisions, or for hacks, forks, outages, sanctions, orders of authorities, or any other event beyond our reasonable control.

  18. Changes to the Service

    We may change, pause, limit or stop any part of the Service at any time, with or without notice: coins, networks, features, limits, fees, Stealth, payment links, the API or the whole Service. An order already confirmed is completed or refunded under the rules it was made with.

  19. Our relationship with you

    Using the Service doesn't make us your agent, broker, adviser, trustee, bank, escrow or payment processor, and creates no partnership, employment or fiduciary duty. Each swap is a separate transaction under these Terms.

  20. No warranties

    The Service is provided as is and as available, without warranties of any kind, express or implied, including fitness for a particular purpose, non-infringement and uninterrupted operation. Cryptocurrency prices move fast, and you accept the risks of using cryptocurrency and blockchains.

  21. Limits on our liability

    As far as the law allows, SilentMule and the people behind it are not liable for any indirect, incidental, special, consequential or punitive loss, or for lost profits, revenue, data or goodwill, arising from your use of the Service. That includes losses from network congestion, blockchain forks, smart contract failures, price movements, user error such as a wrong address or network, or anything else outside our reasonable control. Where liability can't be excluded but can be limited, our total liability to you for all claims together is capped at the fees you paid us in the 12 months before the claim arose. Nothing in these Terms limits liability that the law doesn't allow to be limited.

  22. Indemnity

    You agree to cover SilentMule and the people behind it against any claim, loss, liability, fine or cost, including reasonable legal fees, that comes from your use of the Service, your breach of these Terms or of any law, anything you sell or buy through it, or a dispute between you and anyone else, including your customers if you are a merchant.

  23. Our name and work

    The SilentMule name, mule, logo, designs, text and code belong to SilentMule or its licensors. You may not copy, change, sell or build on them without our written permission, except where the law allows. Coin names and logos belong to their owners.

  24. Disputes and governing law

    If something goes wrong, write to us first: most problems are solved by talking. Where the law allows, any claim about the Service must be brought within one year of the event it is about. If a dispute can't be settled that way, it goes to the courts where SilentMule's operator is established, and these Terms are governed by that place's law, unless the law where you live gives you the right to go to your own courts.

  25. Taxes

    You are responsible for working out, reporting and paying any taxes on your swaps. We don't collect, withhold or report tax for you.

  26. Changes to these Terms

    We may update these Terms to reflect changes to the Service or for legal or operational reasons. The date at the top shows the latest version, which applies from the moment it is published. An order already open keeps the Terms it was opened under.
